    my wife is not living with me now becuase we are both students in different states. She wants to file for me, where do we do the filing? is it where she is based or where i am based? she is a citizen and do we need to hire a lawyer for the fact that we are not living together?

    You file in the place of your joined residence. As students that can be your school, her school, or her parent's address. Remember, when the time comes, you both have to attend the interview.

    You do not require a lawyer, but you are going to have to go to greater lengths to show evidence that yours is a legitimate relationship. Do you travel to meet each other? Do you correspond regularly? Is there a good reason for you to go to different schools? Do you have demonstrable plans for after graduation? Can others attest to your relationship?

    It is pretty obvious when a marriage is real and when it is a sham. If you have a real marriage, don't worry. Do make it easier for the officer to decide in your favor... document document document.
