Of course, you can apply even if you are out of status, if you have a credible fear to return in your country.

    Thanks Yaman,

What are the steps I should go through to obtain such a case? Is using a lawyer's help will give me some benefits?

Getting a competent lawyer will benefit you by helping you explain procedures and basically ease any of your worries you may have of the intricate, complex laws. Keep in mind that lawyers don't perform miracles, they are there to see how they can help you out.

I've gone through the list of the free legal service... some of them will require : Must meet income guidelines for representation. What does it mean? any idea?

It probably means that you have to justify not being able to pay for legal services. You probably can't make more than a certain amount of money.

Don't wait too long, though. An asylum application needs to be filed within a year of your arrival in the U.S. If you miss the one year filing deadline, you could have a hard meeting one of the exceptions (depending on your circumstances).
