Thread: Immigration Law Question: EWI after deportation in 1999

    one of my friend was deported in August 1996 because of denial of his asylum application and re-entered without inspection in 1998. His employer filed labor certification for him in March 2001 and I-140 was approved in September 2002. Later on, He filed I-485 along with I-485A in 2004 which was denied in 2006 based on inadmissibility section 212(a)(6)(c) and section 212(a)(9)(B)(1)(II).
    My question is that since it is 16 years after his exclusion order issued, or it is 14 years after his reentry, can he file his I-485 again?

    No, but the original deportation order can and will be reinstated and executed without any legal recourse on the part of the alien.

    He may also be criminally prosecuted for re-entry after deporation.
