Thread: How long can a green card holder stay overseas?

    We have a couple green card holders (just got it), but due to family issues(aging parents), the green cards holders have to travel. But, in the last few entries, the airport immgrantion officer seems gave them a hard time and quesioned them why they are not in the state.

    One had applied and paid "reentry permit" (only two years), it only can apply two times.

    The other did not. It used to be Six months (180 days) will be fine to stay outside of US, but we were told it changed to only Four months?

    but, in the INS website, it says one year.

    Could someone share with us, what is the new time frame allow to travel overseas?

    We want to follow all the rules, and don't want to have any trouble at the entry point (Int'l airport.)

    Your input will be deeply appreciated. Thanks.

    You didn't realize that you had aging parents BEFORE you immigrated???

    A green card is NOT a glorified tourist visa!

    If you're not actually living in America, the USCIS can revoke your green card at any time.

    It would seem that immigration authorities already believe that you're not really living in America. You say that you have been questioned "in the last few entries." You can't be very smart if you continue with the same behavior that already has raised suspicion of your residency status.

    You're either living in America...or you're not!

    Technically speaking it's 1 year, however several smaller trips outside the US will raise flags if they occur regularly and could cause issues. At any time, immigration officers can question you and it is possible they could believe that you have abandoned your residency.

    Should that happen, it's not an automatic revocation. They will send you before an immigration judge and you will then need to prove that you are maintaining your residency - keeping a domicile, maintaining bank accounts, paying taxes etc etc.

    The standard is that you reside in the U.S. That is acutally living here. Just having a driver's license, credit card, property, etc. is not enough, you have to spend more time here than overseas. Get used to it.
