Thread: In Removal Proceedings

    Dear Friends,

    Please advice on the following situation:

    - got married to American citizen, got temp green card
    - filed joint I-751 to remove conditions. In the meanwhile got divorced and wife withdrew the joint petition
    - Got a letter stating that I am in removal proceedings
    - I was called to a local court hearing. I asked for extension by saying I am looking for a lawyer
    - Next court hearing (removal proceeding) Sep, 2010.

    Surely, I will go to the hearing.

    1. Can I give a new I-751 to the judge?
    2. Any other advice or ideas what will happen?

    Go to court in September and bring your lawyer. Isn't that what you asked for?

    Why have you not filed your I-751 waiver application with the same evidence that was submitted with the joint app?? What are you waiting for??? Do it now.. like yesterday so you can get recipt notice. Then you will go into court with the receipt and a copy of the I751 waiver filed and evidence of bonafide marriage to be able to show.

    If you do everything above, you will not need to spend money for I-751 is not difficult to fill out and make copy of.

    Now the wait will be to see if you get approved on the I751 waiver application, depending on where your service center is, could be as little as 4 monthe or as much as 12 months.

    P.S. Hope this was a civil divorce situation, and wifey didnt write a letter of fraud/sham marriage to uscis. Your marriage did not pass the two year test. Hope you have strong and convincing evidence of good faith/bonafide marriage.

    I just got the divorce couple days ago. I have a court hearing tomorrow.

    You need to apply for a waiver for the I-751 so that you can continue on the path to citizenship.
    Always interested in the H1-B visa, the Eb-5 Visa Program and other Eb5 Investor Visa related issues.
