Thread: Greencard...again..

    I was married and got my greencard which I then returned when I needed to go home for an extended period for family reasons and didn't think i would ever return permanently. My wife and I have now decided the states are the best place for us. Do I need to do a whole new application or is there a way to get back the greencard I surrendered?

    Hi Andy,

    You actually surrendered your green card? If that's the case, I'm afraid you will need to start the process over again. How long has it been since you left the US?

    Proud is right but it may not take as long as last time. If your spouse and you have been living in the foreign country for some time now, you may be able to apply directly to the US Consulate there, depending on the country.

    i am actually back in the states now as a visitor unfortunatly, but i know i need to stay now. I only surrendered my card two years ago, does the time make a difference?

    Hi Andy,

    It sounds like your wife needs to start the process over again. When does your visitor visa expire?

    it will expire very shortly. I am worried about doing a re-entry however. I am ready to file a new application, have redone the medical etc. etc. I just wasn't sure if it was the right thing to do. It took forever last time and i was stuck in Canada for over a year and i can't have that happen again. Do i need a lawyer you think? Can I extend my stay as a visitor?

    You can't extend your stay, no.

    And it won't matter how long ago you surrendered your green card. You abandoned your residency and now need to go through the entire process again.

    Your best bet would be to try for an adjustment of status, since you're currently in the US.

    You can file for an SB-1 immigrant visa. No sponor necessary. Just fill out the DOS form.
