    Does anyone know the next step involved after a I130 is approved at the uscis level? I know it will then be sent to the embassy in the country where my husband resides after that I dont have a clue.

    The approved I-130, Petition for Alien Relative, is sent to the U.S. State Department's National Visa Center (NVC). The NVC sends correspondence with instructions for beginning the immigrant visa process. (NVC holds preference petitions until the priority date becomes current with the visa chargeable date.) Once the initial processing is completed, the NVC sends the materials to the U.S. Embassy overseas. The Embassy conducts the visa interview and background checks, and once everything is complete, issues the immigrant visa.

    Hi Old Man or others

    I have a question about consulate process. I always hear two side of story about it. My brother's priority date is on June 1996 (F2B) and the current cut-off date is on 07/01/1995. Apparently his priority date has not yet become current. But the NVC has finished all its process and forwarded his case to the U.S. consulate in July 2004. Some people say that priority date does not matter anymore once a case is transferred to the U.S. consulate. Others tell me that my brother must wait for his priority date to become current before the U.S. consulate sends Pack 4 to schedule his IV interview. Anyone has an assured answer for this by experience?

    Certain preference based cases may be sent for processing early, especially if there is a chance for the CCA to apply. But, the visa can not be issued until the proper priority date becomes current.
