Thread: Maiden name vs. Married name on AOS application

    I am a US citizen and I am getting ready to file/send my I-485 AOS
    application for my overstay wife. She has an approved I-130. My
    question is, on her I-130, I-94 and my tax returns she used her maiden
    name. Can I now use her married name on the AOS application packet I
    am going to send to the INS? Would that cause any delay or problems?
    Can I just attached a copy of our marraige certificate as a proof of
    her name change? Or is it better just to maiden name on the AOS
    application?

    She can use either name - send your marriage certificate with your application. If she uses her maident name, she can have that on her documents or she can choose to have her married name. She can also hyphenate her sirname.

    unless the instructions for the application clearly indicates that you need to send an "original" document, NEVER send an original..always a copy
