Thread: Maiden name question

    Hello,
    My fiancee (US citizen) and I (hold F1 and currently under OPT) are gonna get married pretty soon, and gonna apply for PR to adjust my status. My fiancee was thinking to keep her family name until the school ends since she was afraid if she changes her last name right away after we get married, she's gonna have problem with things related to school.
    I was wondering if she keeps her original last name until the school ends, will it make a problem with my green card application that I will send to USCIS? I was worried if later on the USCIS officer will think differently about her keeping her last name until the school ends.

    The best way to solve a problem is by eliminating what may cause it. You still have a hanging problem with I-864, why add this one? The question is why does she want to adopt your last name at all? If she does, she would have to update her records in around a dozen databases. The "Moore" in Demi Moore is the surname of one of her husbands one dozen marriages ago. (Just kidding Demi).

    A name has nothing to do with "good faith"... You may wanna keep your name for whatever reason, it's irrelevant to the actual "good faith intent" of the relationship. Many women keep their name for professional related reason, others do it because of personal, more intimate reasons.

    Anyway, consult with a lawyer if you have questions.

    I don't think you should run into any problems, If you think or she don't want to change her last name to yours, it makes no difference, I have seen many ladies like to keep the original last names.
    Provided the marriage is in good faith.

    If you have any problems you can check with your local USCIS Office. or consult an attorney.

    I am all for women keeping their name, or even a man to take the womens

    However, through my own experiences, yet I was the alien not the USC, I did have problems, and confusion.

    I am not sure how it's done in your State but in mine to change a name after you get married, you have to go to court and file something to change your last name.

    You also have to remember, that if she does change her name (after you filed with USCIS), you will have to make sure that USCIS have those details, because one mistake can really mess things up for you, paperwork wise. USCIS do have a habit to make mistakes with paperwork, so bear that in mind.
