Thread: Granted Canadian Residence while AOS Pending

    I have an AOS pending (married to USC). As a backup strategy, I applied under the Canadian Skilled Worker program for which I received approval this week. Problem is: I need to travel to Canada to register for my PR card. I'm not sure whether I can use Advance Parole in this case. Please advise.

    What is your AOS based on, are you a person who is required to register for special registration from certain country?

    Well,
    You can apply for advance parole and go do your thing in Canada. As an individual on AOS you HAVE to apply for advance parole otherwise you won't be allowed back in the country.

    As for your registration in Canada, I know that you have a year to cross the border fromm the day you are approved, which means you have more than enough time to apply for AP and go.

    Something else while strategising, if you have overstayed, applying for AP is not going to be a good idea since you might fall in the 3 to 10 years ban, you might have to choose between pursuing LPR in Canada or in the US.

    Assess your personal situation before acting.

    Mazen - my AOS is based on I130 (married to a USC). No, I'm not required to go through special registration.

    Thanks Kalla - I started my AOS while I was on F1. I've since been in school although not on full time bases. One more question though: Wouldn't it be a problem if BCIS know that I went to register for PR in Canada? Just wondering what should be the reason for my AP. Regarding the time for which the Canadian Immigration visa will be valid, I do not know yet. I received the final approval letter this week and they asked me to submit my passport for the visa.
