Thread: Health Insurance

Does anyone know if it is required to show proof of legal status to get health insurance?
A friend of mine has a social security card and drivers license but no current greencard. His employer asked for resident card. I was never asked that for health insurance. maybe life insurance?

It's an employer's legal responsibility to be able to prove that he/she has appropriate paperwork and proof that their employee is legally able to work in the US. It just follows that the person would have to have legal status in order to join the company's health plan.

If an employee has "legal authorization" to work (EAD, etc.) and a Social Security Card then they are eligible for the company health insurance. The employer cannot discriminate based on status if the employee has been legally hired. If the employee has a valid passport and Social Security number (valid) which authorizes them to work the employer needs to offer the same health insurance. I don't know where you live but I saw this type of discrimination a lot in Texas. My employer would "cross off" the names of the hispanics when it came time to enroll them in benefits. I turn him in and, eventually, he was fired for that and other issues.
