Thread: Question about divorce of residents who lives in USA

  1. #1
    Hello , I have this question ,
I am here from about 3 years , I came originaly from turkey,
when I came here I was married in my home country , I am now looking for divorce
can I make my divorce in the USA or I have to return back to turkey to get the divorce ( and this thing I cant do )

I live in vegas , and I know if there was more than one year of no cohabitual
contact between the couple , the spouse may ask for divorce,
if yes , What document I have to prepare for that purpose for example the marriage certificate or what ?
Note that I dont have children from my marriage
and I am now having my AOS pending and I just wante to start new life here

    Regards

You will have to go back to Turkey and submit the forms required by Turkish Law. You will have to look that up. You need a lawyerr - not an immigration forum. Good Luck.

Why not lodge suit for divorce here in the USA? It would be handled by "process service" to her in Turkey. I can't imagine that the US Court would not deal with it as any international divorce.

In the event that your national custom requires the decision to be accepted by a Turkish Court, then I suppose once you have a decree here in the USA, you can petition the Turkish Court to enforce a divorce decision decreed by the American Court. You might need the assistance of a Turkish Attorney.
The above is simply an opinion. Your mileage may vary. For immigration issues, please consult an immigration attorney.
