Thread: Difference in Name between Birth Cert. and Naturalization Cert.

  1. #1
My mom was told to add my dad's last name to her maiden name on her green card already when she first entered in the US few years ago. Recently she passes the citizenship interview and the immigrant officer asked my mom if she wants to change name. My mom said "No". Then the immigrant officer "automatically" used her green card's name (i.e. her full maiden name with my dad's last name) to put on the naturalization certificate. Her Oath Ceremony will be held some time in this month later. Now she is worrying if the name on her birth certificate and naturalization certificate is different (just my dad's last name added on her Naturalization Certificate), will it affect her petition to her children?

Your mom should have chosen the last name she wants to have and live with, and not worry about petitions in the future.

Your mom could have used a last name like "Garfield" funny, but true and possible.
A name will have nothing to do,in order to petition a son, daughter or any other family member.

All they will always need is an original birth certificate from your native country!

So u better make sure your mom chose the right last name, because this will be her legal name.Which means she will have to update, anything and everyhting with that name. Credit Reports, Driver's License, her passport will have that name etc, social security needs to be updated with the new name..

Hope you mom did not make a mess, because of a silly last name, just because of a petition, because petitions have nothing to do what someone's last name might be!

    Thank you for HBKHBK's response.

Since the immigrant officer has already added my dad's last name on her green card when she first entered the US, all her documents such as scciety sercutiry card, ID cards and etc are with this name.

    My another concern is:
I know people who request to change name during the interview will receive a paper (kinda like court order)in the Oath Ceremony to prove their name being changed. How about my mom's case? Actually her naturalization certificate will keep using her green card's name. Will she also be considered to have a name change because she has my dad's last name (compared with the name on her birth certificate which only has her maiden name)? Will she get that piece of "legal paper" during the Oath Ceremony?

Your mom can change her last name, first name anytime...even after all the ceremony etc.

All she needs to do is check her state law/city and legally change her name...

but she will have to do all the hasle again, with updating every single place with her new name..even if its only a last name
