Thread: Late Amnesty Case Info# 2

    The first document is a sample letter to be directed at US Citizenship and
    Immigration Services. This letter should be submitted in order to indicate
    to the government that they violated the regulations of the settlement in
    failing to timely process your application. USCIS will have 45 days in which
    to reply, correcting their mistake.

    If they do not reply within 50 days, you may appeal to the special master,
    using the 2-page form enclosed. These appeals must be filed within 30 days
    of the 50 day mark (ie, within 80 days of submitting the initial letter to
    Robert Raymond at USCIS).

    I recommend that you fill out the Special Master appeal form and gather
    necessary materials as well as the $62.50 filing fee shortly after
    submitting the initial letter. There will be no reminder of pending
    deadline, and you will be expected to submit the appeal in a timely fashion
    (within 80 days from sending the initial letter, 30 days after the 50 day
    mark)

    Pursuant to ∂ 9C of the settlement in Catholic Social Services, et al., v. Ridge, et al., Civ. S-86-1343-LKK (E.D. Cal.) or Newman, et al., v. Ridge, et al., No. CV 87-4757-WDK (C.D. Cal.), please take notice that the above-named applicant intends to appeal to the special master from defendants' failure to adjudicate his or her application for legalization in accordance with the time targets stipulated in 12 of the settlement.

    The applicant filed a completed form I-687 on or about ______________. Pursuant to 12 of the settlement, the I-687 should have been adjudicated by _________________, yet the application remains unadjudicated.

    Please advise within 45 days whether you have rectified this deficiency.
