Thread: Immigration Law question (sponsor)

    My wife is my sponsor for my AOS marriage based. I am currently on F1 status. we do not have anyone for co-sponsor.

    Her 2010 tax return is not above 125% as requirement by USCIS.However her 2011 tax return will be around 20k,

    so will it be risky to file for AOS now? altough her 2011 income will meet the requirement? we are planning to file next week...
    Please help!!!

    She needs to provide tax returns for the past three years. If they're under what you need, you should probably delay filing and have her file this years as soon as possible.

    thankyou aroha..Her all last 3 years is under USCIS requirement.

    I talked with an lawyer today, lawyer told that if her current income is more than 19k , it's safe to file...what you think?

    If the lawyer said it, then go ahead. They do take note of current income.
