Thread: Lawyers, Anyone: Please Help Me!!! What should I do???/

    I'm a USC and my fiance is traveling back and forth to the states working on one of cruise lines(that's where he workds). His job is going to end in november at that time, he has 21 days before his current visa expires....I really love him and wouldn't want him to leave. we will get married while he's here. I really don't wish to be away from him anymore,what should we do so that he can stay? I would appreciate any help! Thank you in Advance.

    Ameksy,

    If your fiance has C1/D visa, he cannot change his status in the US. You two can get married in the US, you file I-130 to initiate process. He will have to go his home country and have an interview at the embassy / consulate there.

    " You may be ineligible for adjustment to permanent resident status if:

    You entered the U.S. while you were in transit to another country without obtaining a visa.

    You entered the U.S. while you were a nonimmigrant crewman. "
