If a citizen has been married before to a noncitizen, but are now divorced, can she marry another one and help that person with a naturalization by spouse?

If a citizen has been married before to a noncitizen, but are now divorced, can she marry another one and help that person with a naturalization by spouse?

  3. #3
Yes, that's possible. Although, the application might undergo a little bit more scrutiny, and if the USC is still financially obligated to the first nonUSC, that needs to be declared in the I-864 affidavit of support

  4. #4
Helping "another one with Naturalization" should not be the sole intent of the marriage.
The above is simply an opinion. Your mileage may vary. For immigration issues, please consult an immigration attorney.
