Thread: Claiming parents abuse or spousal abuse on i 751 form ?

    My wife, who now lives separately for the last two months use the cover of spousal abuse to get a change from conditional greencard to permanent green card. She is employed now. If I approach through my attorney and submit eveidence that she had intention to commit a very serious criminal offence against the family and spouse, would it be possible to stop the waiver application ?

    Hmmm.. where there is smoke there is fire.


    She must have evidence to submit that would support the charge of spousal abuse for the waiver? Is this correct?

    You will need to supply all information here.

    Were you abused by your wife? What is the reason for seperation, and was there any police reports written?


    BTW.. You cannot stop the waiver process. The waiver will be adjudicated by an immigration officer who will approve or deny the petition.
    You will not be called to court per say about it. The best thing you can do is submit pertinent information to the service center with her alien number so that the information will be in her file as a complaint. This way, the information will be available for the I/O to see when he reviews her waiver application.

    If she has evidence of abuse by you, then that evidence will stand on its own to support her case.
