    Citizens CAN be deported !!!

    From this story, it is clear that ILW.com has become an advocate for illegal criminals rather than a board seeking to help worthy and decent people that deserve to be here ! SHAME ON ILW.COM !!! Now I can deport 2 lunatic citizens (probably the same person) I know back to Canada !

    Hmmm.

    So, you are saying then, that if you were to read the opinion in the Peres case -- http://bibdaily.com/pdfs/Perez%20v.%...%208-15-06.pdf (granting habeas relief) -- that the court reached a bad result, or that the government was justified in withholding exculpatory evidence on the question of defendant's US citizenship...?

    If the guy is so stupid that he does not know or did not have evidence that he was a citizen then he should be deported. It should not be (and really is not) the burdern of the government to "prove" that someone is innocent. As the appeals demonstrate, and are conveniently left out of the links, he is deportable and should be deported immediately.

    The burden of proof in immigration cases is on the petitioner not the government. The government simply needs to show that the petirioner did not meet their burden of proof. This has been established over and over again and is incorporated into the laws. Many regular courts and state courts do not know immigration procedure. Immigration is a Federal, not a State subject matter. State Court decisons carry absolutely no weight in immigration cases. Carrying out deportation is an administrative and not a criminal matter therefore the government need not adhere to the strict criminal rules of evidence and procedure.
