Thread: please help...

    I have very hmm... compicated story. I came to us on J1 visa and then applied for assylum(there where reasons) but beed denied. Then I apllied for appeal, after BIA denied it (they denied it 100 % now) I needed to aplly for federal court, my lawer failed to cantact me and I suddenly find myself as illigal...Then I met a guy and fell in love, but he was merried this time and waiting for divorce, we decided to wait for him to be free and get married, but while we were waiting i got deportation issued( police extually came to my house to arrest me , but i wasn't there this time), now he is free and we are getting maried... We went to 5 different lawers and they all saing different things, like one ove them saing i need to go back and then try to get back in other one saing i need to file 130 and then take my chanses on interview( his words you need to roll the dice of beeing or not deported) I cannot open my assylum case becouse country conditions have changed. So i'm don't really now what to do... my fiancee is here ,my mom, my uncle and his family... i 've been here for 7 years all my friends are here. I don't want to roll the dice with my live, because if i'm stuck back there i just don' t have anybody and anyhting there. i'm not criminal, I just want to live normal life, to go to school have a baby and so on.I don't know wich lawer to trust. Is it possible to do something without leaving the country... if yes maybe you can tell me with what to start....so i can figure out wich lawer is lying .... thank you very much in advance.

    thanks a lot, but what mean order of removal entered in absentia? is it good or bad? I didn't received any notice...unless it been lost ,because i mooved.... i don't keep my adress up to date becouse i'm afraid of being taken in. And i cannot choose lawer because evry one of them is saying that his only way is good...I already done mistakes by taken bad lawers and now I'm afraid of doing it one more time. i was trying to do everything by law and correctly , but now i'm in situation that i'm scared of everything and afraid of walking on the street...****s... thanks again for reply....

    Oh my God, you know so much... so you think if i don't have return rule its possible to do it without leaving US?

    I mean is it possible to do it just through marriage, if it's imposibble to reopen my assylum case?

    Yes, if you do not have the 2yr requirement, it is possible. Now you have bigger struggles ahead of you than that if you were ordered deported and did not leave.

    First of all, get married right away as Davdah suggested. Start all the evidence of valid relationship etc, bank accounts , leases bla bla. Your relationship will be under major scrutiny because of the situation.

    You must be very careful too. Once you file the I-130, they will know where you are and they will come for you. You will be placed in detention center. Those visits will usually come early hours in the morning between 6 am and 8am. Maybe even at your job. Be prepared.

    It was foolish of you not to keep your address up to date so that you know what was going on in your case after the denial. Your lawyer should have explained that you would be in removal proceedings. He probably did and you took the route of head in the sand approach to just stay at whatever cost.

    Eventually , this will work out for you, but it is not going to be a quick fix, nor will it be cheap.

    YOu need to find out about your case without getting caught. Go back to that lawyer to get information, because I am sure his file was updated from uscis as he was probably the address on file to receive paperwork.

    You have not given us any timeline in this matter from the denial of the asylum case.

    Is your other family that is here legal? If not, you want to make sure that you do not jeopardize them by living with them.

    Your asylum is done. finished as it was denied twice. It was perceived as bogus claim.


    YOur problem is you probably received nta and did not appear. You would have been offered voluntary departure at that time. Instead it appears that you were orederd deported in abstenia.

    my mom having green card, waiting for citizenship, my uncle is already citizen, so i don't think there will be problem. i been denied on asylum 3 years ago, then I waited for first decesion on appeal for 2 years then i waited for a year for my boyfriend to divorce. Nobody ever told me it was so serious, I know i made a mistake by trusting lawers to much. it was pretty long time ago so i cannot even contact that lawer right now. Extually i found out more information from you then i did from all my lawers. You said they going to take me to detention center, but for how long????? is it possible somehow to avoid it, i'm already for a year in constant fear,i have panick attack at least every day, i would just go crazy if i would know that somebody will come in the morning and take me somewhere...i don't know maybe go away somewhere for that time, it could take 6-8 mionth? thank again

    I cheked i don't have that return rule, it was simple work and travel visa for 3 month, for sure i will not do it by myself, i'll get an attorney and i hope the good one, I don't care about how much it will cost or how long, as long as everything is done right, but with my bad previous expirience i want to know as much as i can so i can follow my lawer somehow i hope that he will be able to preven from ICE showing up, truly , i feel like kinda a criminal...i guess i'm , but the idea that somebody can come and get me just driving me crazy... i feel much better after you told me all this,thanks
