Thread: From OPT to H1B

    Hi All,
    I am now on OPT, it will expire on 30 April 2007, an employer wanted to
    hire me but they found out that the H1B cap has been reached (even for
    the advanced degree category which I qualify). What is the probability
    the Congress will increase the cap in October? If the cap is increase,
    can I file in Oct and what is the probability of me getting my H1B
    approved? If the Congress does not increase the cap and the employer file
    for me on 1 April 2007, what is the probability of me getting my H1B
    visa approval and what is the processing time? Do I need to leave the
    country and come back after I got my H1B? What other option do I have?

    Even in the very unlikely event the cap is increased in October, you'd probably have thousands of people ahead of you.

    As it is, even if your prospective employer applies for you on April 1, 2007, and gets approval immediately, you are still not able to start work until Fiscal Year 2007, which begins Oct. 1, 2007. So, you'll need to find some way to maintain your status between April and Oct. 1, or leave and return on the H1-B.
