Thread: Failed to Appear. How to stop deportation?

    I'm writing on behalf of my friend. He is an older man , who is in INS detention now. He filed for asylum last year but failed to appear at the hearing. So I.J ruled against him in "absentia". He was detained by ICE recentrly and they told him they will deport whithout bond.
    Is there any way to stop deportation and restart the case?
    The country he is from is former Soviet Country is famous for human right viloations and has massive prison system. He was a goverment official and run from persecution.
    Is it possible to be sent to other country, if all means to stay here are exhausted, rather than to his native country.

    You need to get him a good attorney. He should have had one in the first place - being a high govt official and all. What happened to his attorney?

    Did you receive a copy of the removal order (the paper notifying you of the judge's decision made during the hearing)? You need to get an attorney as soon as possible!

    Depending on how far removed he was from the date the ij entered the removal order, he could appeal. He has to have a very good explanation to why he failed to appear.

    Besides the assylum, does he have any other form of relief? Very few lawyers will touch assylum cases, anyone that tells you he/she can, is probably just be after your money.

    Try to find a copy of the removal order while you are at it. It will help give us a better idea of the dilemma your friend faces!

    And OF COURSE someone else has to be blamed for his "crime." What crime did he commit in HIS country that had him persecuted? War crimes? Crimes against humanity? Extortion? Corruption?

    Был бы простым illegal alien, жил бы припеваючи.
