Thread: Urgent: H1 B visa refused 221g

  1. #1
I have been asked to provide the following documents when I went for H1 B visa in the third week of Feb, 2004.

    1. W2 forms for other employees
    2. Photos of the company inside and outside
    3. List of all employees and dates of entry and exit onto job(Are they
    on H1/L1 visa).

Currently the no of employees in the US company are less and are around 10. All of the employees are in good standing with clear documents. My employer intimated that they will be sending the w2 forms and other
    details asked.

    My questtions are:
To the third question, my employer told me that all the employees are
on H1b. Does this small number and all in H1b affect my getting visa?

Specifically, if all the employees are H1B, does the consular feel that
there are no local employees (non h1 b) in it and possibly reject my
    visa?

I was told that if the H1 b visa is refused twice with 221g it will be
sent to INS for revoking. is it true?

I shall be grateful if you can help clarifying the above as i need to
attend the interview shortly with the requested documents.

    Thank you
