Thread: What happens if US spouse deserts his/her immigrant spouse?

    What happens to the immigrant spouse, who has temporary residence, if the US spouse decides to leave or divorce him/her? Can the immigrant spouse still gain permanent residency and eventually citizenship? Anyone out there that this has happened to?

    what is timeline and circumstances.

    Is immigrant at fault for breakdown in marriage?

    No, immigrant is not at fault... US spouse has left the country to work overseas and left the immigrant spouse here, although they still have a communal home. Immigrant spouse has just received conditional temp residency.

    Going to work overseas is not reason to divorce someone??? Has the USC asked for a divorce?

    Or is this a case of immigrant now has greencard in hand and wants to know if they still need to be married in order to gain access to the other benefits/citizenship?

    No, not at all. Immigrant is very upset at spouse leaving. US spouse seems unconcerned and immigrant is worried that the marriage is going to fall apart because of his leaving. She adores him.

    Its no problem then, the guy just has to go to a job. She can visit him there. Have her keep good records and make sure her name is on lots of things, keep records of phone contact and emails, during this period when conditions have to get removed in 2 years. I-751) filing.

    She will be fine if at that time he would choose to divorce.
