Thread: DV Lottery & Labor Certification

    Hello,
    I won the DV lottery for 2005. I was told I should apply ASAP. I already did and I was interviewed, but I was told that my case is aprovable as long as there is a visa number available. Right now I have a pending I-485.
    My question about my DV lottery case is: The fiscal year for the DV lottery ends on September 30th, 2005. The Department of State already announced the cut off number for September, 2005 and my DV number was not reached. Let's say toward the end of September they used 49,880 visas out of the 50,000 dedicated for DV Lottery, will it be possible if they can pull my case and assign one of the remaining visas out of the 50,000. Keep in mind that the ones that will not be used by the end of September, 05 can no longer be used and can not be moved to the next year.
    I hope I made my request clear and understandable.
    Also, can you please, let me know if you have any updates about processing the RIR Labor Certifications in the Dallas Backlog Center in Texas? My labor Certification application was received on 08-25-2005 in the Labor Department in Minnesota.

    Possible but highly unlikely. Remember, USCIS does not have to use all the numbers.

    DV is much better than H1. Hope you get DV visa first. Good Luck.
