Thread: AOS interview - postpone or not? HELLLLLPP

    Some of you may be familiar with some of the story.

    AOS interview scheduled for 8/16. Issues:

    1) pending DUI and refusal charges;

    2) expired passport.

    Charges are misdemeanor level, NOT a crime of moral turpitude (erm, they attempted to deport a couple of people ... however, if they ask: have you ever been arrested, I'll have to say yes and tell them that the outcome, i.e. guilty or acquitted is not known because my court is not until end of September. I've been advised to postpone because of this but now I'm tempted to just show up and see what happens.


    If I rechedule, the INS 800 number says it could cause severe delays and loss of some immigration benefits while in process. Does anyone know what it could mean besides having to repeat background check and medical? Could it be that I would be denied EAD or Parole?

    I don't think I've ever been so confused in my life.

    HELP.

    What is your current visa status? On what petition are you adjusting status? I am not an attorney, but I would say go to the interview. A DUI shouldn't be that big of a deal, but if you have an attorney, I would check with them. You could also call an attorney from this site and ask.
