Thread: EAD - can a temp card be issued after 3 months ?

    Hi I just got my H1-B Labor approved, and I've applied for my EAD + GC (april2004). The problem is that I REALLY need to get my EAD before August2004, because my employer wants to hire me as a permanent employee as opposed to a temporaty employee. If I do not have my EAD by August, I will get laid off.

    - My lawyer says its taking anywhere from 3 to 10 months to get EAD approval, so I have no choice but to wait with my fingers crossed.

    Now, my understanding is that after 90 das of receipt of EAD petition, I can go to the local BCIS Office and request a temporary EAD card. IS THIS TRUE ?

    Those knowledgable on this issue are requested to kindly respond to this question.

    Whether you can go in person after 90 days that your EAD has been pending depends on your local USCIS office procedures.

    If your EAD application doesn't get approved or denied within 90 days after your receipt, after 90 days you can go to the Detroit office and get an interim EAD (if there is no RFE or similar pending).
