Thread: Imminent divorce, have couple of questions

    Here is the situation:

    Separated from ex-spouse for over a year.

    We do not have any joint credit card debt but I am an authorized user on one of the credit cards. I never used and have asked the credit card company to take my name off it.

    We have a joint account on the spouse's car loan. But the spouse is paying for it.

    Also, spouse accumulated student loan during the marriage.

    Now we are headed to divorce court.

    Will I be liable for any of these debts once the divorce is final?

    What should I do now to save my butt?

    Thank you!

    You should visit nearest s-e-x toy store and buy some very nice butt plug.

    Other than that you should read and try your best to comprehend whatever the loan/credit contracts say.

    You can take it from there.

    According to the car loan contract, we are both liable for it. The spouse has agreed to keep paying for it.

    Should I mention in the dirvorce decree that the spouse is liable for it? Another possibility is to refinance the car, but the spouse is not willing to od that. How can I force the spouse to refinance the car?

    As for the student loan, I did not sign any paper on it and it does not show up on my credit report. Should I assume I am not liable for it?

    We live in a property community!

    I guess you mean a community property state? I thought that in those everything was split 50/50 but I'm not sure. In non community property states the two parties have to come to an agreement before the divorce as to who gets what and who is responsible for what or the judge will decide for you. Is there an immigration issue here? If not, you need to post on a divorce forum.
