Thread: Can I loose a green card?

    My husband and I have been married for 8 months, I have had my green card for for about 3 months. We fight on daily basis and there is a lot of emotional turmoil that I go through with him. We have a six month old son but I can't take it anymore. He is threatening to tell immigration to take my green card since he pertitioned for me to get it. I suspect that he can't do that, but is it possible? I have the two year permanent residency. Will I be able to get permanent residency after two years if I leave him? Do I need to stay even when it's not working out just to wait for the end of two years? It seems unfair to me that I have to endure this abuse and having our son see this. If I leave him, what are the concequences?

    YOur husband cannot order or ask USCIS to take your green card away. However, if you divorce and the divorce was not "your fault," you might be able to remove your conditions on your green card. You will need to prove you had a bona fide marriage, provide evidence to support that claim, and a copy of your divorce degree. Depending on facts and circumstance, you have at least a reasonable change to remove your conditions. I urge you to look here for more info.

    If you leave him and divorce, you will not be required to wait for 2 years to remove conditions. That being said, the choice to divorce will depend upon you and whether you believe you have adequate evidence of a bonafide marriage.
