Thread: Need help really bad (fiancee visa)

  1. #1
I would really appreciate if someone has an advice for me.
    here is my situation:
I am an F-1 student here, who is on OPT. Prior to this I was a J-1 student (1999-2000), went home for over a year and came back in 2001 on F1 visa. I still have 10,5 months of home residency requirement and plan on going home to fulfill that this April.
I just got engaged to an LPR, we've been togather for almost 2 years by now.
He has applied for his citizenship through Nebraska and his interview is scheduled for 7th of March, 2004.
He is going to file for fiancee visa right after he gets his citizenship. Shoud he wait and file after my 10,5 months are over, or five or so moths before my home stay is over, considering that fiancee visa roughtly takes about 5 months to process.
I would really appreciate any advice, or suggestions.

    Thanks a bunch

PS Can anyone tell me, how long it will take for my fiance to get his passport/citizenship after the interview

    Hi julia,

You have already answered your question ... just count the approximate time period that is best for you and your spouse can apply for fiancĂ©e visa .... I don't have experience with fiancĂ©e visa but once they issue you visa probably you have 3 – 6 months time period to enter USA on that visa ... so even if he applies for you little bit earlier ... there should not be any problem .... Wish you all the best... Pasha

About citizenship not quite a sure but my mom-in-law got NATZ certificate same day when she had interview ... and then got passport in about 2-3 months ....

Pasha, thank you for response, guess, I'll just keep my fingers crossed
I was just a bit concerned that INS might not accept the documents for fiancee visa, if I am not completely done with my foreign residency requirement.

    Hi Julia,

They will accept and work on the application but your reentry in USA will be possible with completed requirement of previous J-1 visa... wish u all the best ... Pasha

Awesome, this is really helpful, I was afraid it's gonna be more than 10,5 months, but that ew can handle.
    Thanks a bunch, Pasha

I am still waiting for my interview. They do not send me interview letter yet.
But two days ago I had big fight with my wife.
She wanted to spend $300 on dress and I refused to pay for it.
    So, now I worry.
What if she mess up everything before interview?
She say she will report that I bought my degree for 100 rupees in Bangladesh.
This is not true and I don't know where Bangladesh is, but what if someone beleive her?
You know, some people are crazy, they beleive anything.
All these years I wait for interview and now this ****

Please, if anyone has similar experience, let me know.
Patti sent papers almost same time with me and already got interview and approval.
And many other people I helped to file for , they all passed interviews and all.
    I am still waiting.
And my wife already say she never wanted to marry me and only did a favor to me so I can get a Green Card.
She say she thought I am a doctor, so could make good money and buy her everything she wants.
Now she doesn't need me anymore.

Please, if anyone has similar experience, tell me what should I do?
    Should I wait for interview?
Or should I start divorce now?

    Thank you!

    **** ON ME
