    We have a problem we hope you can help us with. We applied for an immigrant visa for my mother one year ago. We also applied for an immigrant visa for my brother who is nine years old at the same time. A few months after we applied I called the INS information line and asked the question that when my mother got her visa would her son who is a dependant be covered by her application and would be able to come when she got her visa. I was told that since he is a dependant child he could come with her. Yesterday we got the Immigrant Visa Bill for only one person. I called the National Visa Center and they told me that my brother was not covered under my mother's application and would not be able to come with her. We do not understand why a nine year old child will have to wait up to five years to come to the US if his mother has an immigrant visa.

    Please, give us advice what to do,

    Unfortunately, it is twelve years wait for brothers/sisters of US citizen to receive an immigrant visa. For parents, however, the visa is available as soon as I-130 is approved. You are the sponsor for both, i.e. your brother in this process is depending on your sponsorship, and not on your mother's.

    It appears that your mother will not be able to move permanently to the US, unless she leaves your brother behind.
