My friend's dad is a Citizen and petition his unmarried son over 21 who lives in the United States on Feb of 1992. Can the unmarried son apply for I-485 and I-765? He is from Mexico.

    Thank you for your assistant.

I think your friend qualifies under the 245(i) adjustment of status law.

A person with a labor certification or a visa petition filed on their behalf on or before January 14, 1998 is qualified for the benefits of 245(i).

Under this law, your friend can file an I-485 and an I-485A with an extra $1000 fine, but is able to file all the same and an I-765. Contact me if you want help, I've done these before.
