Thread: fiance visa

    can anyone help?
    My friend came here illegally 8 years ago, and he does not have any documentation in regard to immigration. But his fiance wants to apply for a fiance visa for him, but the problem is: he has to go back to our home country to apply, since he's been here in the U.S he did not have no legal papers but a driver license. Is it possible to do it, even if he went to jail for a traffic violation, or do you guys think: on the way back after finger print, he's gonna show that he was in the U.S before, even if he's not in the system. Since he's from canada he would not have to be fingerprinted at the border.

    yes if he was fingerprinted it will be shown in his FBI report that he was in US. onwards ther should be no lie.. take the 601 route from another country is best bet.
    Its a discussion, not a legal advise..
