Thread: Help with Asylum Case

    Hi everyone,

    A friend of mine has an asylum case that has an upcoming court hearing. The person came here with a spouse's asylum case. When things went awry, and she experienced domestic abuse, stalking, and death threats, she divorced. These events occurred even after her divorce.

    The two of them will have the same court hearing. She is from a country that is reknown for its blood feuds, and I wonder if her personal wellbeing is at stake if she has to go back, with or without her exhusband (she would be returning to the same city as her ex husband)

    Would this justify a new asylum case? If so, how could we go about it?

    Hi Kamar and welcome,

    This is confusing. Is the husband still in the US or back in his country of birth? What is the wife's status? Green card?

    The husband is still in the US, but they share the same court date and lawyer.

    The wife is here on the same pending asylum case as her husband. The original reason for asylum was she was not allowed to study for political reasons. She has, however, graduated from an American college, and will apply for med school.

    If she has to return to her country of origin, she faces hostility and possible violence on behalf of the husband and his family. My concern was whether she should continue with her original asylum case or file a new one?

    Now not getting an education is grounds for asylum?

    Who is the primary applicant? Is the husband listed on his wife's application? If so, if they are not divorced at the time of the granting of asylum, he gets it too.

    She needs to remove him from her application if she is the primary applicant.

    if your husband is the main applicant, then it will be a challenge for you. you should have changed lawyers before going to the hearing.
