Thread: The Law Today Regarding Marrying someone who is undocumented

    The situtation is this. Say somebody comes into this country undocumented, then falls in love with an American Citizen. Say they get married. Now she would like to bring her two children to this country. How can she do it? How can she obtain her legal status? I heard that the law has changed so that she is required to return to her original country for say at least six months before she can return here to the US legally. Is this true even if she married an American Citizen?

    Undocumented? How very politically-correct.

    In any event, if your fiance entered the country without inspection (forgot to bring her passport or bother with legal ports of entry), then she will be unable to adjust her status without returning to her country of origin.

    Once in her country of origin, she would automatically be subject to a ten-year bar against reentry, so her application for an immigrant visa will be denied at the U.S. Consulate. After the denial of the application, you must file a waiver for the bar against reentry...a process that takes a long time and has variable degrees of success.

    and this process should be even more complicated or waivers should just be disallowed for those who have thumbed their unwashed noses at our laws and borders, then found one of (sadly) many village idiots to marry and then (a) whine for a green card, weeping about our 'unfair laws' and (b) attempt to bring the rest of their irresponsible family members to the US to leech off of the American taxpayers....well, I say eff that idea....anyone who EWIs should be barred forever (and a day) and never be rescued by some last-minute phony marriage to some moron.

    Why would she be "automatically subject to a ten-year bar against reentry"? I've already spoken to an immigration lawyer about this. Unless she has broken some law or has actually been caught here, then its not an issue.

    For unlawful presence (which is breaking a law). Bar starts when that person leaves the US. The person in question has to leave because she entered illegaly and as such can't (in most cases) adjust status in the US.

    Sundevilusa post seems to be quite correct and non judgmental, not sure why the fuss.

    The ban depends on how long she has been here illegally, if over 180 days, needs a waiver so does not really matter.

    The Children do not need a waiver, so assuming under 18 they could come first.

    but, in spite of that annoying wanking doll of tiinydiktimmy, the illegal would have to have obtained a lawful status first, and EWIs cannot adjust status even if they marry the village idiot (or timmy, whomever is dumber)....so, no visa for the kids until the mom has a legal status, and she doesn't get one until she leaves the country, faces the ban, and gets a waiver (no certainty about getting one, either, no matter how many times one wanks in front of timmy's wanking doll)
