Thread: student status and CSPA

    Hi,

    I have a few questions and would appreciate any input. I am on F1 status right now. If I apply for I-485 would I lose my student status? A lawyer told me that one cannot hold two different status so once the INS accept my application, I automatically lose my previous status. Is that true?

    Also, I've noticed that nobody has posted anything on the CSPA for quite a while now.. From the memo I am pretty sure that CSPA does not apply to me. I am a beneficiary derivative under F4 category. My mom applied in 1990 and we got the approval the same year (less than a month later). Our priority date became current last December and my mom has filed for adjustment of status. I am 26 now so I guess I am not qualified. However, some lawyers, as well as INS officers in a local office told us that I am qualified. I am a bit confused now. I would just do it anyway but I am afraid that I would lose my student status. What do you think? Thank you in advance!

    Hello Jeff,

    First thing,CSPA doesnt related with your F1 status.It wont help you on base of F1 status.

    By reading memo, its prety clear, in this world i think 1% child will cover in peticular F4 category by CSPA .Because the INS pending days will be always in motnhs.It shld not be more than one year.

    Which INS officer and Lawyer told u that u are eligible.If the INS office has review yr case very well then tell u and if INS office is in comitee of taking decsion of immigration then u can put trust on him but if he is just a counseller u cannot put trust on him.

    Hi naik,

    Thank you for your reply. My concern was that if I do apply for I-485 adjustment of status then my F1 status will be automatically void. At least that's what the lawyer told me.. he said I cannot have dual-status so my status will be "application pending" or something like that.

    cspa does not apply to f4 anyway,dont waste your time in searching benfit from cspa,
    it is piece of bread to hungry man,
