Thread: Help, I'am really confused about which way to go!

    hi everyone,
    I'am a US born citizen and I got married last year in my husband's country without any of my family present. We want to have a small wedding in the states and have my family there at the ceremony. Since I still have not file petition for his visa would I be able to apply for a I-129F visa instead of the I-130? or maybe both?
    P.S. I'am living in NY and my husband is still in Cyprus :-(

    Hi! Congratulations on your marriage. Since you are already married, you can't file a fiance visa for your husband. You should file an I-130 and as soon as you get the receipt notice from BCIS, file the I-129 for K-3 visa for your husband. Good Luck!
