    After 4(Four!) years of waiting for an interview letter from local INS we finally found out, with Congressman's help, that our file was send to Archive by mistake! Now they tell us that get the File back will take 6 more months and they are going to decide if there is any action should be even taken! I think Congressman did all he could in this case. This is a nightmare. So what do we do now?!!!
    Please, somebody- any advice?

    I see that INS is a country out of USA's rights, laws and rules. They can do mistakes, do nothing or even wrong. No responsibility for any wrong actions, no regrets or sorry. If immigrant do any mistakes he can be punished by law or action, but not INS. I am sorry for you, Lena. Mail the letters to Director of your INS office. I am not sure this help.

    OK this is a simple case of paper trail with so many loopholes on the part of INS but you might be in the losing end if you do not act properly.
    INS can claim that this case had been abandoned since they have not heard from you,assuming they have sent something about your papers.It is your word or they that you have not received any copy of their mail.Note,however, that is not the first time INS had done this mess.And if you are out of status the more they will leverage against you especially with the present political climate.Keep all your records and study your next move.Best of luck!

    They can't say that case was abandoned. I was constantly reminding them that we are still waiting, annoying them with letters and in person. They LIED to me that it's all fine and they just behind and our turn will come. But all that time our file wasn't even there anymore. Only when Congerrsman got involved INS admitted that file was send to archive!
