Thread: Do they qualify?

    The company is willing to pay me a prevailing wage on 1099.
    They have never sponsored anybody and they are currently inactive - I would be
    the only employee.
    They have no assets but only $400,000 line of credit.
    Do they qualify as a green card sponsor against Labor Dept. and BCIS criteria?

    If so how long would it take to obtain a LC in the state of Maine/BOSTON (state
    processing is current, regional is 3 months backlog) RIR case?

    The problem is that they are hiring you as an independent contractor, that is why you would receive a 1099 instead of a W-2. Normally, you need to be an employee of the company.

    A $400K line of credit should be enough to show that it is a viable company.

    According to my experience BCIS does accept independent contractor wage paid to the beneficiary before he is elidible for EAD during I-140 processing.
