My finance's brother was picked up on criminal drug trafficing charges,Class X Felony, he is charged with intent to distribute Xctacy, he was framed by a supposed friend of his. Its a long story, but the guy was put into a real messed up situation, he is facing a minimum of 7 years, with a 50/50 shot of being found not guilty. He is technically in the country illegally, by means of his visa expiring a few years back. He's a good guy holds a job and comes from a good family that resides here in the US. All of his family members have legal citizenship except for him. I dont know all the details something about how when his father was sponsored by his employer, he was over the age of 18? Regardless.. He is charged with Class X Felony, he is facing a minimum of 7 years. We posted bond of 25,000, Immigration came and picked him up and are in the process of deporting him. The individual was told by immigration that they would have to notify, Dupage County IL of there plans of deporting him. His trial has not even started yet. My question is.. if they have already posted bond in the Dupage county can the county courts interfere with the deportation process? In all honesty we were hoping he would be deported and ordered never to return to the USA again. Any insight, advice or opinoins are greatly appreciated!!!

it may be harsh answer but truth of matter, he will be deported. He got bail from the drug charges but under immigration law Two or more mesdeamenor or one falony makes the alien removable.. under 8 CFR.
Any crime that have the Max sentence of more then a year makes alien deportable.. he is illegal here , there is no way he can get out of this mess.
Its a discussion, not a legal advise..

who cares? Ship this drug dealer back to whatever third world pit he came from....or was he doing the jobs that Americans won't do? And the OP gives new meaning to the word "good."
