    dear lee,

    i believe yes! it applies to the persons being petitioned even though they're outside or inside the US territory!

    the law is silent and general rule as what the convention of law provides it means YES! the bottomline of CSPA is not the location of which the petitioned beneficiaries reside or is currently at the moment but the issue that CSPA is trying to touch and solve is the IMMIGRANT STATUS ELIGIBILITY with regards to the AGE OF THE AFFECTED CHILD and not the PLACE.

    however, i cannot comment on your case since it was a PAROLE case u mentioned.

    ive read the law and it says that the CSPA is applicable to immediate relative, family based sponsored visas, DV lottery and refuggess/asylees.

    if your case/ petition status falls into any of these cases then you are qualified to avail of the CSPA subject to the condition that you're mom
    has not been issued an immigrant visa yet.

    but if your parole case does not fall within the
    petition cases i mentioned above, then theoretically you are not entitled of this law.

    my best advice, consult a lawyer.
