Thread: CIS and ICE Going Overboard on Marriage Fraud to cover the misconduct

    On Nov 12, 2009 the US Eastern District Court filed an Indictment against Wilairat Khamphaphon and Burton Levenson for marriage fraud and conspiracy. Mrs Khamphaphon, a Thai national was married to David Cather 6 yrs earlier and together with Levenson's assistance began the process for permanent residence. The INS, then renamed CIS lost their file and it took over 2 yrs to process her I-751. Wilairat complained to the CIS about the delay and lost file, and subsequently, the CIS Adjudicator "escalated" the file to supervisory level taking off all mandatory processing time limits. Khamphaphon concurrently filed a N-400 for naturalization, passed her test, and was on the verge of becoming a US Citizen. CIS's response was to move the file to the fraud investigation and then ICE took over. Wiretaps, broken down doors, and immediate incarceration in hand cuffs and shackles for the 96 lb 5 ft petite Thai woman resulted in her breaking down and "confessing" to marrying for immigration status. Her husband was likewise threatened and ICE has turned him against her with corroborating testimony. This is now out of control with innocent people being roped into the "conspiracy" and charged with serious felony crimes against the State.

    There should be something we can do to stop CIS and ICE from abusing the system to cover their own inadequacies and incompetence. A review of the CIS - ICE - Dept of Justice cases waiting to be investigated, all with higher priority in terms of number of individuals involved and real organized criminal activity, show that pursuing this case is just not worth it. It is costing the government 100,000's of dollars to pursue this in criminal court before a jury trial for what - to prove (based on the testimony of a terrorized husband and wiretaps between husband and wife arguing) that a single marriage fraud took place. Is the bar set so low now and their manpower and budget so high that CIS and ICE are pursuing the most flimsy of cases worth it? A cautionary note to all potential immigrants.

    No abuses here, just putting dirty criminals in jail for their crimes. Get used to it, you will be spending some time in the gray bar hotel.

    I wish ICE and CIS would investigate even more bogus marriages between dirtbag illegal aliens and their moronic supporters. If they (ICE) followed up on the manatees over at immigrate2us.cud, they would find out that about 97% of those marriages are phony.
    Keep the slimebags out of our country....stop rewarding illegal aliens, visa cheats and border jumpers just because they marry some dodo who lives in a trailer park.

    Assuming this is real, there would have to be a good reason for them to take such a heavy handed action. Usually with suspected marriage fraud cases they'll arrest them at the interview or get the person to come to the office for some other reason then arrest them. It's unusual for the them to hand it over to ICE unless it's part of a marriage fraud ring or the person is considered to be an immediate threat in some way. They just don't have the manpower and budget to go after every suspected marriage fraud case in this way, right or wrong.

    All of that said, they are required to give in writing what she is allegedly accused of. That's the beginning of a defense case.

    You failed to state what prompted the investigation in the first place? If she had already passed the test, what was the trigger that brought ICE on board? Something is missing.

    If the original law for conditional residency was untouched, there would not be a problem. Originally, a marriage had to last 2 years after getting the conditional green card. Not so hard. But the scammers didn't want to wait 2 years so they used VAWA as a backdoor to have "abuse" as a way out of the requirement and massive fraud erupted. To make matters worse, IMBRA was passed to make it even easier to commit fraud. They should repeal IMBRA and VAWA and return to the 2 year rule. If a marriage can't last 2 years it could not have been that sincere and no one could have established roots in the US so much in 2 years that leaving would be a hardship. This simple rule would save a lot of money and prevent a lot of fraud.
