    Hi,
    I need some help regarding my case. I Filed I-539 at MSC, and gave my fingerprinting also.
    At present I am H1-B Visa, and it will expire on Dec 2nd,2002. Do I need to apply for an extension of my H1 or can I stay here in US legally as my I-539 is filed and approaval is pending.
    Thanks and any advice is appriciated.

    hi,
    I had also applied for a V visa this April, and got the approval in September.

    I was also on an H1B when I applied. Once you get the receipt notice from INS (confirming that they received your application), you can stay here legally based on just that. You don't need to be on any other visa to maintain your legal status.

    Of course you cannot work or study when you're waiting for your V1 approval, unless you apply for an H1 or F1.
