  • Discrict Director approval did not consider, Why?

    Anna applied petition for her children, the consulate denied the approval of Anna's petition because Anna's first husband declaration of presumptive death was done prior to her second marriage. But, when Annas' left her country she used this documents and show the consulate and she was allowed to leave the country and leave with her second husband. Anna make an appeal to the District INS and the District Director exercise a prosecutorial discretion on Anna's behalf due to her 11 years stay in U.S. and continue leaving with the second husband. One of Anna's Kids is now in U.S. but he daugther were denied, because the INS said that the Annas is not entitled to file petition. Question the son were granted but the daugther did not. Is the decision from the District Director is cannot be considered with the present administration. The director that give prosecutorial discretion is not longer the director. Any help
