  • About termination of deportation

    Hi,
    I'm from japan and My husband is american citizen.
    and also our 3kids too,
    I was on deportation proceeding but finally, judge said he terminate my deportation proceeding.
    and told me to file I-485 again.
    (I have I-130 approval notice already)
    this was happen last month and now Deportation officer wants me to come see him.he said it doesn't matter what the judge said about my case.
    I'm so worried about if I go to see him and he put me into custody and send me back to my country?my husband was recently deployed(he is in navy reserve) and no one take care of my kids.
    Do you know why he this deportation officer wants to see me?

      I guess immigration officer will put stamp on your passport for approval change of status.But you need to File I-485 accordingly to get your Green card.
      Make sure when you will go to see immigration officer you have your valid Passport & Take a copy of deployement Order's with you about your Husband.And also take with you the court order, when they dissmissed your deportation.

        To Kyon:
        You should contact your attorney immediately and file your AOS application before the Judge, who is dealing with your case. If you plan to go and see the deportation office, make sure you go with your attorney and with that order from the judge vide which deportation is cancelled.

          Thank you for your reply for my question.
          So, he won't put me into custody, right?
          I thought somebody else put the stamp on my passport not deportation officer.
          anyway, I'm going to file AOS and I'll contact my attorney again for this situation.

            Your attorney should go to the clerk office and get the immigration Judge's order of cencellation of deportation, and remand order, in the other hand he should file the AOS(i-485).
            With this orderYou are safe and should not be deported.
