No adjudication on I-130

What if an I-485 is denied, but the I-130 was never adjudicated. Is there anything we can do?

Can we get the BIA to adjudicate it? If the BIA refuses, can we bring the issue to the judge?

Untill or unless I-130 is approved by INS, your AOS application can not come up for interview. If you AOS is denied, it means that I-130 was approved earlier. You can file appeal against denial within 30 days.
