My son is a permanent resident who is in prison on aggravated battery (he got 4 years)so he is probably going to be deported when he completes his time. His fiance is the mother of his child and they want to marry. Will this further complicate his INS problems or will it give him an justifiable argument when the deportation order comes down?

Is the fiancee a U.S. citizen? Is the child a U.S. citizen? Will your son be subject to any sort of persecution and / or torture should he be deported back to his country? Does he plan to marry the fiancee in the near future? Is his fiancee able to move to his country should he be deported?
