    I have an employee that is ready to apply for his citizenship however he is concerned that he has an undocumented adult/dependant living with him.(handicapped) who came in legally on H4 but was advised only to apply for g/card for h-4 dependant after one was approved and issued to him (parent). (ended up not really correct advise but...) On the application it asks for all children names and addresses and A#. Obviously his dependant is now out of status so has no number. Is this going to be a problem for the citizenship application - could they ask for documentation of the dependant and could this ultimately lead to deportation. His idea was to apply for unmarried child over 21 once citizenship was approved.
    Any help/advise/suggestions will be greatly appreciated. Thank you.

      Yes, this is a big problem. If he lies and is eventually found out, there could be criminal penalties and revocation of citizenship. Best bet it to send the dependant back home immediately (e.g. before he completes the application and can honestly state that the alien is not in the U.S.).

        What is relation of dependent with your employee?

          The relationship to the employee is his eldest son - totally/fully dependant on him (mentally handicapped) and not able to be sent back without the parent. Is there some type of humanitarian group that would be able to help. The applicant has been in the usa for 12 yrs an asset to the company and we and he would really not like to return home as he has strong ties to the comunity here.

            Tak,
            you asked what the relationship was to the applicant - (which is his first born son) and is mentally handicapped and fully dependent on the parent and entered legally on an approved H4. does this help his case/ circumstances?
