    My husband I filed all the papers to have his status of change done so he can get his permanent residence. He was currently working under an OPT. He won't receive his new EAD before his OPT runs out. It will be by about 3 weeks. We can't afford for him to quit working for 3 weeks. Does anyone know what type of penalties we face? Could it jepordize his status altogether?

      I am USC citizen and My Husband on OPT too what a coincidence,But anywayHis OPT will expire in November and we must have submitted his paper by then, and yeah It will take 3-4 weeks to get an EAD, and techinically He will violate his status but since he is married to you, It wont effect his status at all unless he is MOST UNLUCKY guy, here is my email add : yahooo25@hotmail.com, I use MSN , try to add me too ur MSN or email me and we will pass on information , thanks.

        Thanks for your reply. I know that he is fine "status" wise. My concern is if he works past when his current EAD, provided by the OPT, expires...will that endanger is AOS or the I-130? We need him to work. But, it isn't worth risking everything. We are going to go in next week and see what the delay is. Also, I guess if they ask him if he is currently working..he should just say yes. I figureit is better to be honest about it.
