I'm the UK husband of a US wife and because of some bad advice from the INS
national helpline (sic) the I 130 petition was filed initially without
I485/I864/I765 being filed. We now have the I130 approval notice and I'm
about to file everything else. However, I do have a couple of questions, to
which it would be helpful to know the answers. Gratitude in advance!!!
The I485 asks for the G325 biographic info to be filed - however we have
already filed G325s with the I130 - do I really need to filed new ones?
(Note that the I130 was filed and approved at Vermont wheras everything else
has to be filed at NYC).
I485 asks if you have: "b. been arrested, cited, charged, indicted, fined or
imprisoned for breaking or violating any law or ordinance, excluding
traffic violations?". Well, when I was a 17 year old juvenille I was
convicted of petty theft and got 2 years probation, and was released from
the probation after 1 year. Please note that this was 31 years ago - I'm now
48! Do I have to report this offence? In the UK this is known as a 'spent
conviction' and it doesn't appear on any police record.
If I do report it, is it going to delay my application any further than it
is already delayed? - Can't afford any more delays!!! What are the consequences if I don't initially disclose, because I didn't believe I had to, then later disclose with full documentation regarding the offence. (Thus avoiding any delays!!!)
